This notice explains, in general terms, what information may be processed in connection with the Flint application, this website and our related services, and why. It supplements Article 10 of the Licence Agreement; where the two differ on the handling of personal data, this notice governs.

Not every category described here is processed by every version, edition or configuration of the Software, and a given release may process considerably less than this notice permits.

1. Who we are

Vatt Labs LLC, a company organised in Florida, United States, is responsible for the processing described here and is the data controller where that concept applies. You can reach us about anything in this notice at flint@vattlabs.com, which is also the address the Licence Agreement names for notices and for requests about personal data.

This notice covers the Flint desktop application, the pages under vattlabs.com relating to it, and the services we operate in connection with them.

2. Information we may process

Depending on how you obtain and use Flint, the following categories may be processed:

• Licensing and entitlement information — licence keys and identifiers derived from them, activation and deactivation records, trial, plan and entitlement status, and the timing and outcome of verification checks.
• Device and environment information — operating system and version, locale and time zone, hardware and architecture, memory, storage, graphics and display characteristics, device or host name, and identifiers derived from device or installation characteristics.
• Software information — version, build, edition, release channel, installation and update state, configuration and preference values, and which features, commands and settings are used.
• Usage information — events, counts, durations, sequences, performance and resource-utilisation measurements, and statistics derived or aggregated from them.
• Diagnostic information — crash and error reports, exception records, stack traces, logs, state captured at the time of a fault, and technical details of the files, formats, codecs and devices involved, which may include file names and paths.
• Network information — IP address, approximate location derived from it, request and connection metadata, user-agent strings and timestamps.
• Purchase, account and contact information — name, email address, billing and transaction records, and correspondence with us. Payments are taken by a third-party merchant of record, and payment-instrument details are handled by that party rather than by us.
• Support information — the contents of any support request and anything you choose to attach to it, which may include logs or diagnostic files.
• Your content — only where a feature you choose to use requires it, the media, projects or files you work on, or parts of them, may be processed in order to provide that feature.

3. How it is collected

Information may come from you directly, when you buy a licence, activate it or contact us; automatically from the Software and our websites as you use them; and from the service providers described below, such as the payment and licensing platform through which a purchase is made.

4. When the Software connects to the internet

Flint is a desktop application and does its editing work locally. It may connect to the internet in order to:

• activate, validate, renew or release a licence, and to detect licence sharing or misuse;
• check whether a newer version is available, and to retrieve release information;
• download optional components, models, assets or data that a feature requires; and
• where a version provides for it, report diagnostic information about faults.

Where the Software offers a setting to control any of this, you may use it. Some of these connections are made to third-party services, which will see the request and the network information that comes with it.

5. Why we process it

To supply, operate, maintain, secure and improve Flint and our related services; to issue, validate, enforce and support licences and entitlements; to detect, investigate and prevent fraud, abuse, unauthorised use and security incidents; to diagnose and fix faults; to understand how the Software is used and to develop it; to provide support and communicate with you about the product; to process transactions; and to comply with legal obligations or to establish, exercise or defend legal claims.

6. Who it may be shared with

Information may be disclosed to service providers and processors acting on our behalf — including hosting, storage, content delivery, payment, licensing, analytics, error-reporting and communications providers; to professional advisers; where required by law, regulation or legal process, or to protect rights, safety or property; and to a successor or acquirer in connection with a merger, acquisition, reorganisation, financing or sale of assets.

We do not sell personal data, and we do not share it for third-party advertising.

7. International transfers

We are based in the United States, and information may be stored and processed there and in any other country where we or our service providers operate. Those countries may have data-protection laws different from the ones where you live. Where required, transfers out of the European Economic Area, the United Kingdom or Switzerland are made under an approved transfer mechanism.

8. Retention

We keep information for as long as it is needed for the purposes described above, and afterwards for as long as legal, accounting, tax, security or dispute-resolution requirements call for. Anything the Software stores on your own device stays there under your control until you remove it or uninstall.

9. Security

We take measures intended to protect information, but no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Legal bases

For people in the European Economic Area and the United Kingdom, we rely on: performance of a contract, for licensing, purchases and support; our legitimate interests, in operating, securing, supporting and improving the product and in preventing misuse; consent, where a feature or applicable law requires it, which you may withdraw at any time; and compliance with legal obligations.

11. Your rights

Depending on where you live, you may have the right to request access to the personal data we hold about you, to have it corrected or deleted, to restrict or object to how it is used, to receive it in a portable form, to withdraw consent where we relied on it, and to complain to your data protection authority. We do not charge for making a request and will not treat you differently for making one.

Write to flint@vattlabs.com. We may need information sufficient to verify your identity, and we will respond within the period the applicable law allows. Some information is necessary to license and operate the Software, so a request to delete it may end your ability to use licensed functionality.

12. Children

Flint is not directed to children and we do not knowingly collect personal data from them. You must be of the age required in your jurisdiction to enter into a binding contract in order to purchase a licence.

13. Third-party services

Purchases, licensing, hosting, downloads and optional components involve third-party services that operate under their own terms and privacy notices. We do not control those services and are not responsible for their practices.

14. Changes to this notice

We may update this notice as the product and our practices develop. The current version is the one on this page, and the date at the top shows when it last changed. Continuing to use Flint or this site after an update means you accept the revised notice.
